The new penal code, the Bharatiya Nyaya Sanhita (BNS), 2023, has restructured the provisions of the old Indian Penal Code.
The offense of "voyeurism" was previously criminalized under Section 354C of the IPC.
In the new BNS, this offense is now covered under Section 77.
It retains the definition of voyeurism as the act of watching or capturing the image of a woman engaging in a private act in circumstances where she would usually have the expectation of not being observed, and provides for punishment for the same.
